Please read this agreement carefully, before accessing or using the Service. If you do not accept the Terms and conditions expressed here, do not use this Website, Application or the service. By using this Website and or Application and or the service, you expressly agree to be bound by the Terms and Conditions set forth herein without limitation or qualification. and acknowledge that any other agreements between you and Premium Taxis and Limousines are superseded and of no force or effect. All content in the Premium Taxis and Limousines Website (the “Site”) and Application is intended only for residents of Australia. Premium Taxis and Limousines maintains the Site for your personal use and information.

 

These are our relevant general terms and conditions (Terms and Conditions) that apply to your visit to and your use of our website at www.premiumtaxis.com.au (Website), our Services and Application, as well as to all information, recommendations and/or services provided to you on or through our Website, Service and/or Application.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE DOWNLOADING OUR APPLICATION AND/OR USING OUR SERVICE.

Premium Taxis and Limousines is a Service enabling you to book, and pay for, a vehicle Transfer through the use of an application supplied by us and downloaded and installed by you on your single mobile device (smartphone) (Application) or via our Website.  It connects you to drivers so that the drivers may pick you up and take you where you need to go. The Application allows you to track the driver’s location and manage other functions. All services provided to you by means of your use of the Application and/or Website are collectively referred to as the Service.

General terms and conditions

By registering on our Website or Application, you consent to the validity of these Terms and Conditions. Neither the registration nor the use of the complete spectrum of Services shall be possible without the consent to these Terms and Conditions.

We reserve the right to amend these Terms and Conditions at any time. Following such amendment, the continued use of our Services by you is subject to your consent to such amended terms and conditions. Your continued use of the Services following posting of any changes to this agreement constitutes acceptance of those changes. It is your responsibility to check this agreement periodically for changes. Premium Taxis and Limousines may also, in the future offer news services and/or features through the Services. Such new features and/or services shall be subject to these Terms and Conditions.

Your agreement with us

By using our Services, you are entering into an agreement with us to be bound by these Terms and Conditions. In order to be able to first use our Services, you first need to sign up with us. When signing up, you are obliged to provide us with your personal information. Upon successful completion of your signing up with us, we will provide you with a personal account, accessible for you with a password of your choice. You may also choose to provide us with your credit card or account details.

 

Waiting Time (Apply only for point to point service)

Airport Domestic Arrivals: Waiting charges begin 15 minutes after the scheduled pick-up time.  After 15 minutes, waiting time is retroactive to the scheduled arrival time. Waiting Time charges are assessed hourly. We do not charge any waiting time fee for any flight delays. Please note we must have the correct flight number & airline on airport pickups.

Airport International Arrivals: Waiting charges begin 45 minutes after the scheduled pick-up time on departures.  After 50 minutes, waiting time is retroactive to the scheduled arrival time. Waiting Time charges are assessed hourly. We do not charge any waiting time fee for any flight delays. Please note we must have the correct flight number & airline on airport pickups.
Non-airport Pickups: Waiting charges begin 15 minutes after the scheduled pick-up time.  After 15 minutes, waiting time is retroactive to the scheduled pick-up time. Waiting Time charges are assessed hourly.

Train and Cruise Ship Schedules cannot be monitored therefore billing begins 15 minutes from the scheduled pick-up time.
 

All Cancellations
All cancellations must be sent via e-mail to This email address is being protected from spambots. Save this e-mail for future reference as timely proof of your cancellation. 
we do not accept phone cancellations. The date on which the cancellation notice is received by Premium Taxis and Limousines its agents will determine the applicable cancellation fee. It would be advisable to follow up with a phone call. We do not take any responsibility for cancellation fees resulting from mistakes, the weather, family emergencies, double booking or wrong dates or information.  If cancellation is made less than 24 Hours from time of scheduled reservation the full charge of reservation will apply. Charge backs from credit card issuing banks are subject to the above policies.
Point to Point Service Cancellations
Round Trips must be cancelled as two separate reservations. A cancellation fee equal to the trip cost will be charged for any cancellation booking made less than 24 hours before scheduled pick-up time. Cancellations not within 24 hours of scheduled pick up time will result in a full charge equal to the cost of the trip. Full payment is required for reservations. Charge backs from credit card issuing banks are subject to the above policies.
Hourly Service Cancellations (Applies to all vehicles) 
Payment of 100% of reservation Fee will be charged at the time of booking for all bookings made at hourly rate charges. Cancellations not within 24 Hours of scheduled pickup time forfeit 100% of the total bill. Charge backs from credit card issuing banks are subject to the above policies.

Wedding and Special Event Package Cancellations (Applies to all Vehicles) 
All Wedding and Special Event Deals are 100% Non-Refundable if not cancelled within 72 hours of booking time, whether or not the service is used.

Where to Meet Your Driver at Melbourne  Airport

Terminal 1- T1 Qantas
Chauffeur meeting Point is at the Gloria Jeans Café near the luggage carousels.

Please make contact with your driver before collecting your luggage.

Terminal 2-  T2 International
Chauffeur meeting point is located near the Optus Shop On the ground level at Arrival Hall.

Terminal 3 -T3 Virgin
Chauffeur meeting point is at the bottom of the escalator. You will need to proceed to baggage carousel down the escalator.

Terminal 4 -T4 Jetstar/Tiger
Chauffeur meeting point is at Go Convenience Store on the ground level next to the luggage carousels. Please make contact with your driver.

Please note: If you cannot locate your driver at the airport please call the office on 0428 0428 28. One of our staff will then advise you where the driver is waiting. If you fail to locate your driver and do not contact the office by phone and make alternative arrangements, you will be charged the full amount of the fare plus waiting time.

No-Show Fee
A no-show fee equal to the total trip cost plus applicable waiting time will be charged when the passenger fails to show at the designated location.  In order to avoid this charge, passengers should not leave designated pickup locations without calling Premium Taxis and Limousines on 0428042828.

Surcharges
A 20% surcharge for service scheduled Before 5:00 am or after 12:00 midnight will apply.
Stops are charged $10.00 each for in route stops, apply only to flat rates (Point to Point Service).
There is a surcharge scheduled Easter Sunday, Christmas Day, New Year’s Day, Christmas Eve and New Year’s Eve, Spring Racing Carnival, Grand Prix and other Special Events and some Public Holidays. Prices for these days will be Quoted/ Priced accordingly.
note:  Full of payment is required at time of booking.

Methods of Payment
We accept cash and most major credit cards, AMEX, Master Card, Visa, Cabcharge and Accounts.

Hourly Rates
Hourly rates are Billed from the Booking time. Fractions of an hour are charged at a half-hour rate increments, after half an hour the full hour thereafter will apply;

 

Payment

We reserve the right to introduce a fee for the use of our Services. If we decide to introduce such a fee, we shall inform you accordingly and allow you to either continue or terminate using our Services.

We shall charge you for the services provided to you by the drivers on behalf of the drivers. You agree that you will pay for all services, and that we may charge your credit card or account as provided by you for the services (including any taxes and late fees, as applicable) that may be accrued by or in connection with your account. You are responsible for the timely payment of all fees and for providing us with a valid credit card or account for payment of all fees at all times. Any payment made is non-refundable.

Charges to you are based on the quoted fares and any tolls that may apply to your ride. You agree to pay an additional service fee of 5% in New South Wales, Victoria, Western Australia and the Australian Capital Territory and 10% in South Australia, Queensland, the Northern Territory and Tasmania when paying by credit card in the vehicle. This charge will be added to your fare at the end of your trip.

If we use a third-party payment processor (the “Payment Processor“) to link your credit card account to the Service, this paragraph will apply. The processing of payments or credits, as applicable, in connection with your use of the Service will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to these Terms and Conditions. We are not responsible for any errors by the Payment Processor. In connection with your use of the Services, we will obtain certain transaction details, which we will use solely in accordance with its Privacy and Cookie Notice.

We reserve the right
Premium Taxis and Limousines. reserves the right to cancel any Service without Refund, If the Operator or the Office feels that the Renter/Party of the Renter is putting the Operator or The Mode of Transportation or The Renter/Party of the Renter in danger of Injury. Or if the Renter/Party of the Renter is in the possession of any Illegal Material or Substance, this service will be canceled without refund. This is without exception.

Electronic Communications

When you visit Premium Taxis and Limousines or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

Other
Premium Taxis and Limousines shall not be liable for circumstances beyond its control including weather, road conditions and breakdowns. Premium Taxis and Limousines reserves the right to substitute vehicles for reasons beyond its control if Premium Taxis and Limousines is unable to perform under this agreement, its liability is limited to a full refund of money paid by customer, and shall not exceed the deposit paid Premium Taxis and Limousines assumes no responsibility for lost or damaged baggage or personal belongings, nor for any items left in the vehicle.

While every effort is made to ensure specified times are met, if the limousine is late in excess of 30 minutes due to unforeseen traffic, uncontrollable weather conditions, or other circumstances beyond our control, the customer has the option to cancel the service and receive a full refund on the unused portion of the trip. However, if the clients choose to still take the service, then no compensation may be claimed.

 

Acceptance. Use of the Premium Taxis and Limousines.com.au web site at .. (collectively, the “Web Site”) and the on-line reservation services (the “Services”) provided by Premium Taxis and Limousines.com.au.com are subject to the terms and conditions of use set forth below (“Terms of Use”), which include the Privacy Policy set forth at Premium Taxis and Limousines and incorporated into these Terms of Use by reference. please read these terms of use carefully before using the web site or the services. By using the web site or the services, you agree to these terms of use. If you do not agree to these terms of use, do not use the web site or the services. Premium Taxis and Limousines.com.au may change these terms of use from time to time without notice, and such changes will be effective on the date they are posted on the web site. Use of the web site after such changes have been posted constitutes your acceptance of all such changes.

 

ID Number, Password and Security. You are responsible for maintaining the confidentiality of any user ID and/or password provided to you by Premium Taxis and Limousines for use in connection with the Web Site or the Services. You are solely responsible for all activities that occur under your user ID and/or password, and you agree to notify Premium Taxis and Limousines.com.au immediately of any unauthorized use of your user ID and/or password or any other breach of security related to the Web Site. Premium Taxis and Limousines will not be liable for any loss or damage arising from your failure to safeguard your user ID and/or password or to comply with this section.

The Web Site, Application certain content therein, the Services and any underlying software may be protected by copyright, trademark, patent, and/or other intellectual property and proprietary rights laws and are owned (along with all proprietary rights therein) by Premium Taxis and Limousines.com.au and its licensors. You agree that you will not copy, distribute, republish, display, post, transmit, download, or modify any content you obtain from the Web Site without Premium Taxis and Limousines.com.auprior written permission; provided, however, that you may download or print a copy of information from the Web for your use in learning about, reserving, or using the services.

 

No Unlawful or Prohibited Use

You warrant that the information you provide to us is accurate and complete. We are entitled at all times to verify the information that you have provided and to refuse the Service without providing reasons.

You may only access the Service using authorized means. It is your responsibility to check to ensure you download the correct Application for your device. We are not liable if you do not have a compatible mobile device or you download the wrong version of the Application for your mobile device. We reserve the right to terminate the Service and the use of the Application should you be using the Service or Application with an incompatible or unauthorized device.

As a condition of your use of the Services, you warrant to us that you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner which could damage, disable, overburden, or impair the Services or interfere with any other party’s use and enjoyment of the Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Services. You will only use the Services or download the Application for your sole, personal use and will not resell it to a third party. You will keep secure and confidential your account password or any identification we provide you which allows access to the Service.

Premium Taxis and Limousines reserves the rights to immediately terminate the Services and use of the Application should you not comply with any of the above rules.

 

Use of Communication Services

The Services may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, Communication Services), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not: Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Premium Taxis and Limousines reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever. Premium Taxis and Limousines reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Premium Taxis and Limousines sole discretion.

Term and termination 

The agreement between us and you is concluded for an indefinite period.

You are entitled to terminate the agreement at all times by permanent deletion of the Application installed on your smart phone, or closing down your user account thus disabling the use by you of the Application and the Service.

We are entitled to terminate the agreement at all times and with immediate effect (by disabling your use of the Application and the Service) if you:

• violate or breach any term of these Terms and Conditions, or
• in the opinion of us, misuse the Service. We are not obliged to give notice of the termination of the agreement in advance. After termination we will give notice thereof in accordance with these Terms and Conditions.
